These Terms of Service ("Terms") govern your access to and use of services, including SMS/text message communications, provided by AV Capital Group LLC ("Company", "we", "us", or "our"). By subscribing, using our services, receiving SMS messages, or otherwise interacting with us, you accept and agree to these Terms and our Privacy Policy.

1. Acceptance

By opting in to our SMS program or using our website or services, you provide express written consent to receive SMS and other electronic messages from AV Capital Group LLC at the telephone number you provide. Consent is not a condition of purchase.

2. Description of Services

We provide communications related to real estate, probate, foreclosure assistance, account or tenant notifications, appointment reminders, marketing messages, and other information about our products and services (the "Services"). The Services may include links to websites and other resources.

3. SMS / Text Messaging Terms

• Opt-in. Users opt in by submitting a phone number on our website https://main.avcapital.group, by texting a short code or longcode to initiate a conversation, or by providing their number to an authorized representative. All opt-in forms will display a link to our Privacy Policy.
• Opt-out. You can opt out at any time by replying STOP to any message you receive from us. After you send the word STOP, we will send a confirmation message and you will not receive further marketing messages. For help, reply HELP or contact us as listed below.
• Message Frequency & Costs. Message frequency varies depending on your interactions and account settings. Message & data rates may apply per your mobile carrier agreement. We are not responsible for any charges assessed by your carrier.
• Short Codes / Long Codes. Messages may be sent from short codes, long codes, or other sending numbers. You authorize receipt of messages from these numbers for the purposes described.
• Third-Party Messaging Providers. We may use third-party providers to send SMS messages on our behalf. These providers are authorized to process data as described in our Privacy Policy.

4. User Conduct

You agree not to (a) provide false information; (b) use automated means to opt-in others without their permission; (c) interfere with the Services; or (d) violate applicable laws or the rights of others. We reserve the right to refuse service, terminate accounts, or block numbers for misuse.

5. Privacy & Data Use

Your personal information will be collected, stored, used, and shared in accordance with our Privacy Policy. We will not sell your phone number. We may share data with vendors and service providers strictly for delivering communications and complying with legal obligations.

6. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

7. Intellectual Property

All content, trademarks, and other intellectual property used in connection with the Services remain the property of their respective owners. You may not use our trademarks without prior written consent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT WILL AV CAPITAL GROUP LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED AMOUNTS PAID BY YOU TO US (IF ANY) IN THE PRIOR 12 MONTHS.

You agree to indemnify, defend, and hold harmless AV Capital Group LLC and its affiliates, officers, directors, employees, agents, and contractors from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Services.

10. Modifications to Terms

We may modify these Terms from time to time. If we make material changes we will provide notice (for example, by posting a prominent notice on our website or sending a message). Continued use of the Services after changes constitutes acceptance of the modified Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and any applicable state laws, without regard to conflict of law principles. You and we agree to attempt to resolve disputes informally before pursuing any formal remedy. If a dispute cannot be resolved informally, both parties submit to the exclusive jurisdiction of the courts located in the United States (or, if applicable, binding arbitration as described in any separate agreement you accept).

Our Services are not directed to children under 13. We do not knowingly collect personally identifiable information from children under 13. If you believe we have collected such information, contact us and we will take steps to delete it.

These Terms constitute the entire agreement between you and AV Capital Group LLC regarding the Services and supersede any prior agreements. If any provision is found to be unenforceable, the remainder will remain in full force and effect.
